In 1966 the Brazilian physicist Klaus Tausk (b. 1927) circulated a preprint from the International Centre for Theoretical Physics in Trieste, Italy, criticizing Adriana Daneri, Angelo Loinger, and Giovanni Maria Prosperi`s theory of 1962 on the measurement problem in quantum mechanics. A heated controversy ensued between two opposing camps within the orthodox interpretation of quantum theory, represented by Leon Rosenfeld and Eugene P. Wigner. The controversy went well beyond the strictly scientific issues, however, reflecting philosophical and political commitments within the (...) context of the Cold War, the relationship between science in developed and Third World countries, the importance of social skills, and personal idiosyncrasies. After drawing a distinction between a cosmopolitan attitude and institutional cosmopolitanism, this paper reconstructs Habermas’s account of the relationship between morality and law in order to argue that this account can be the basis of a cosmopolitan attitude which, although insufficient, on its own, to ground cosmopolitan institutions, can, nonetheless, motivate interest in institutional cosmopolitanism. The paper then examines Habermas’s proposal for institutionalizing a system of cosmopolitan governance. It distinguishes and explores the reach and limitations of three arguments in favor (...) of institutional cosmopolitanism not always adequately differentiated in Habermas’s work: (a) an argument from the weakness of the nation state, (b) an argument from the democratic deficit of nationalism, and (c) an argument from the state’s incapacity to guarantee human rights. This landmark work will make a genuine contribution to the theory and practice of reparations.

This paper seeks to articulate a conception of justice in reparations for victims of human rights violations when the aim is to repair a large number of cases, as opposed to individual, isolated cases. It starts with an effort to establish some semantic clarity by trying to distinguish between two different contexts for the use of the term “reparations”. It discusses some of the problems with merely transplanting the ideal of compensation in proportion to harm from its natural home in (...) the resolution of individual judicial cases, and using it as a standard of justice for massive reparations programs. Instead, it argues in favor of thinking about justice in the context of massive cases in terms of the achievement of three goals, namely, recognition, civic trust, and social solidarity — three goals that are intimately related to justice. Finally, it tries to shed light on the basic trade-offs that accompany some of the choices that have to be made in the process of constructing a comprehensive and coherent reparations program. Essays exploring the prospects for transnational democracy in a world of increasing globalization.

One of the dominating themes in the first part is the negative treatment that Marx’s concept of labor has received by late critical theorists, particularly Habermas. While supportive of the rejection of Marx’s economic functionalism entailed by Habermas’s adoption of communicative action as the basic category of critical theory, Honneth worries about the indifference towards the normative potential of labor that he sees in most twentieth-century social theory. Honneth agrees with critics of reductionism that labor is neither the only form (...) of social reproduction, nor a primary source of emancipatory consciousness, as the fragmentation and depolitization of a working class that has suffered the effects of Taylorism clearly manifests. But Honneth is still convinced that the experience of recognition is to a large extent associated with work, and that Habermas tends to understand interaction in terms of instrumental action, making the concept of interaction inadequate to capture the sort of normative claims expressed by workers who do not see themselves sufficiently recognized in the labor they do. Although Honneth acknowledges that he has not settled how to navigate between these competing interests, the clarity of the call for a more complex concept of labor justifies the inclusion of these papers in the volume. This chapter describes and analyzes some trends in the design of truth commission mandates beyond their original fact-finding function. It establishes links between the expansion of truth commission mandates and two particular challenges truth commissions have encountered, namely the poor record of implementation of their recommendations and challenges relating to the selection of commissioners. It also discusses the relationship between the temporal scope of the truth commission and its mandate, including a list of the number of years many commissions were (...) given or took to attempt to carry out their mandate. edited by Ciaran Cronin and Pablo De Greiff Since its appearance in English translation in 1996, Jürgen Habermas's Between Facts and Norms has become the focus of a productive dialogue between German and Anglo-American legal and political theorists. The present volume contains ten essays that provide an overview of Habermas's political thought since the original appearance of Between Facts and Norms in 1992 and extend his model of deliberative democracy in novel ways to issues untreated in the earlier work.Habermas's (...) theory of democracy has at least three features that set it apart from competing positions. First, it combines a concern with questions of normative justification with an empirical analysis of the social conditions necessary for the realization of democratic institutions. Second, at the heart of his model is the assertion of an internal relationship between liberalism and democracy. On this account, the rights of the individual that are central to liberalism can be guaranteed only within a constitutional framework that at the same time fosters democratic rights of political participation through the public sphere. Finally, Habermas defends a conception of universal human rights that is not only sensitive to cultural differences but also calls for legal and political institutions that facilitate the cultivation of cultural and religious identities within pluralistic societies.These essays demonstrate the extraordinary power of Habermas's theory of democracy through a further engagement with Rawls's political liberalism and through original contributions to current debates over nationalism, multiculturalism, and the viability of supranational political institutions. While acknowledging the difficulties, both pragmatic and moral, involved in the efforts to try to punish those involved in atrocious crimes, I try to block the quick move to a policy of pardon and oblivion by interposing a moral commitment to the past that stems from a reflection about the nature of moral deliberation and moral identity. I argue in favor of a policy that is both compatible with such commitment, and practically feasible, one centered around forms of remembrance.

The thesis that I have been trying to establish in this dissertation is that ethical systems are constructed on the basis of certain presuppositions about the temporal horizon in which human beings live, and most importantly, of the horizon within which they ought to live. In order to take a step towards establishing this claim, I examine what I take to be the two most powerful ethical theories in the western tradition, Aristotelianism and Kantianism, reconstructing their implications for the relationship (...) between ethics and temporality. I argue that Aristotle's ethics are intended to moderate the future orientation of his psychology by stressing the importance of the past. I suggest that it is possible to provide a temporal reading of Kantian ethics by emphasizing the notion of objective ends. But since this is one of the most tenuous elements in his system, the results will always be unstable. Finally, I argue that Habermas's discourse ethics can be read as an attempt to mediate the differences between Aristotle and Kant, and that it rests on a temporal horizon that deserves serious consideration. This is a temporal horizon that results from understanding the importance of tradition for questions of self-identity, on the one hand, and on the other of universality for questions of justice. AbstractWhile the literature on oncofertility decision-making was central to the bioethics debate on social egg freezing when the practice emerged in the late 2000s, there has been little discussion juxtaposing the two forms of egg freezing since. This article offers a new perspective on this debate by comparing empirical qualitative data of two previously conducted studies on medical and social egg freezing. We re-analysed the interview data of the two studies and did a thematic analysis combined with interdisciplinary collaborative auditing (...) for empirical ethics projects. Despite their different contexts, major similarities in women’s decision-making and reasoning were found. We developed two main common themes. Firstly, women felt a clear need to plan for future options. Secondly, they manipulated decision-times by postponing definitive decisions and making micro-decisions. The comparison highlights that the passage of time and the preservation of future choice seems to permeate all aspects of the patient experiences in both studies. As a result of considering real-world lived experiences, we suggest that there are many overlaps in women’s reasoning about egg freezing regardless of why they are making a decision to freeze. These overlaps are morally relevant and thus need to be further integrated into the existing arguments that have been canvassed in the flourishing egg freezing and fertility preservation debates across the field, and in policy and practice globally. One of the most profound and influential studies of this pivotal event, it remains a relevant and stimulating discussion of the problem of preserving individual and political freedom in the modern world. Alan Kahan's translation provides a faithful, readable rendering of Tocqueville's last masterpiece, and includes notes and variants which reveal Tocqueville's sources and include excerpts from his drafts (...) and revisions. Every day, students from marginalized communities disproportionately face adversity and trauma. It is well documented that exposure to adverse childhood experiences can impact children's ability to focus, learn, and even regulate their emotions. Many schools, rather than providing multi-tiered systems of support to address the root causes of behavior, place these students at greater risk of experiencing health disparities through the use of exclusionary school discipline practices. ESDs not only deny students important educational opportunities, but also can compound existing social, (...) economic, and health inequities. Thus, ESD practices must be understood as more than simply impacting what happens in the classroom. Instead, they should be conceptualized as public health policies with far-reaching impacts on a child's lifelong health and well-being. Even though school discipline has largely been overlooked by the public health community, current reform efforts are one aspect of a holistic health justice framework.This article seeks to begin to bridge current gaps in the literature and public discourse by identifying key linkages between ESD practices and health. It then presents evidence-based design principles to ensure education policy is aligned with a health justice framework. And finally, it explores a specific school-based intervention, restorative justice. (shrink)

The presence and impact of Hispanics/Latinos in the United States cannot be ignored. Already the largest minority group, by 2050 their numbers will exceed all the other minority groups in the United States combined. The diversity of this population is often understated, but the people differ in terms of their origin, race. language, custom, religion, political affiliation, education and economic status. The heterogeneity of the Hispanic/Latino population raises questions about their identity and their rights: do they really constitute a group? (...) With growing public health and health equity challenges brought to the forefront — following racialized health inequities resulting from COVID-19 and a national reckoning around the deaths of unarmed Black victims at the hands of police — an antiracist health equity agenda has emerged naming racism a public health crisis.

This book provides the first complete, literal English translation of Alexis de Tocqueville’s and Gustave de Beaumont’s first edition of On the Penitentiary System in the United States and Its Application to France. The work contains a critical comparison of two competing American penitentiary disciplines known as the Auburn and Philadelphia systems, an evaluation of whether American penitentiaries can successfully work in France, a detailed description of Houses of Refuge as the first juvenile detention centers, and an argument against (...) penal colonization. The work provides valuable insights into understanding Tocqueville as a statesman, as well as a comparative look at civic engagement in early American and French penal reform movements. The Translator’s Introduction provides historical context for understanding Tocqueville’s work in French penal reform and the major themes of the report. The book thus fills a void in Tocquevillian studies and extrapolates the roots of American and French criminal justice systems in the nineteenth century. (shrink)

Are White, All the Blacks Are Men, But Some of Us Are Brave: Black Women's Studies, I imagined a wealth of examples of the world and the work made possible by these two groundbreaking anthologies. I wondered what their editors and contributors were writing now. I wondered about the work of their students and people like me: those of us who understand everything we write as indebted to the path-making, silence-clearing, generative, and bodacious work of the participants in the miracles that are This Bridge Called My Back and But Some of Us Are Brave.But today as I reread the contributions that actually emerged from this process, I realize that my dream was too small. I imagined writing that would provide evidence of the ongoing impact made by these two anthologies. Instead, the creative writing in this special issue offers something more crucial and beautiful than I had imagined. These works are not mere evidence of a transformed world; these works are continuing to transform the world in urgent and visionary ways. As repeated again and again by participants in the 2022 celebration for the fortieth anniversary celebration of This Bridge Called My Back, the work that inspired these anthologies is not over. The writings featured in this issue not only show [End Page 198] how this work continues, but they feed, nurture, and provoke us as we honor our responsibility to transform this world.For example, when Akasha Gloria Hull, coeditor of But Some of Us Are Brave, shares her daily early morning meditative writing in "Writing and Rebirth: A Set of Journal Poems," we remember not only her fundamental work excavating the daily lives of Black women writers from the nineteenth century—most notably in Give Us Each Day, her edited book based on the diaries of poet Alice Dunbar Nelson—but also our own imperative. Hull's reflections on health challenges, interpersonal conflict, resurrection, collaboration, and writing itself remind us that our feminist praxis is impactful because of its dailyness. Those of us who wake up tomorrow will need to ask the same critical questions the editors of But Some of Us Are Brave asked of the fields of Black studies and women's studies. We will find surprises and repetitions in the days we meet, and then we will have to do it again.When we read two new prose poems by Cheryl Clarke, an original contributor to This Bridge Called My Back, we have an opportunity to time travel. In "Living as a Lesbian in the Archive of Style," we venture into a critical engagement with the term "hardcore lesbian," displacing the desires of the person who needs to classify others using that term with those of someone who has been hailed by it. Clarke's poem is a reminder that as we work in literary traditions and fields of study made possible by the revolutionary identity politics of an earlier era, we are still responsible for centering the experiences of those most impacted by our fluent and fluid naming practices. In "History," Clarke offers us a timely Black lesbian feminist lens on many iterations of responding to police violence, centering the perspective of a lesbian, her lover, and her lover's husband.The poem "On Being an hbcu Graduate, Teacher, Professor-Scholar at Stillman College, Tuscaloosa, AL, in May 2015" by doris diosa davenport—an original contributor to But Some of Us Are Brave—highlights the intimacy, hilarity, and poignancy of the daily work of intergenerational critical and creative praxis. In particular, she considers the context of institutions and regions that are sometimes excluded from the imaginary of how and where feminist work happens. davenport transmits the lessons and energy gained through her practice of thinking and gathering otherwise... Was die geistige Leidenschaft beider - so ver~chiedenartiger, so entgegengesetzter Menschen - von vornherein fesselte, war die Frage nach der Bedeutung, (...) nach dem Wo-Hinaus dieser Entwicklung und ihr Verlangen, die entscheidenden Momente dieser Ver änderung bestimmen zu können. The purpose of this paper is fundamentally didactic, in that it approaches in a descriptive way some of the basic notions of the philosophical-political thought of Alexis de Tocqueville including democracy and social equity and the dialectical concept of freedom. This paper focuses mainly on some chapters of the Tocqueville’s masterpiece ‘Democracy in America’ and ends with an epilogue where interpretative ideas are proposed in order to provide an updated framework for his thought.

Although classical evolutionary theory, i.e., population genetics and the Modern Synthesis, was already implicitly ‘gene-centred’, the organism was, in practice, still generally regarded as the individual unit of which a population is composed. The gene-centred approach to evolution only reached a logical conclusion with the advent of the gene-selectionist or gene’s eye view in the 1960s and 1970s. Whereas classical evolutionary theory can only work with fitness differences between individual organisms, gene-selectionism is capable of working with fitness differences among genes (...) within the same organism and genome. Here, we explore the explanatory potential of ‘intra-organismic’ and ‘intra-genomic’ gene-selectionism, i.e., of a behavioural-ecological ‘gene’s eye view’ on genetic, genomic and organismal evolution. First, we give a general outline of the framework and how it complements the—to some extent—still ‘organism-centred’ approach of classical evolutionary theory. Secondly, we give a more in-depth assessment of its explanatory potential for biological evolution, i.e., for Darwin’s ‘common descent with modification’ or, more specifically, for ‘historical continuity or homology with modular evolutionary change’ as it has been studied by evolutionary developmental biology during the last few decades. In contrast with classical evolutionary theory, evo-devo focuses on ‘within-organism’ developmental processes. Given the capacity of gene-selectionism to adopt an intra-organismal gene’s eye view, we outline the relevance of the latter model for evo-devo. Overall, we aim for the conceptual integration between the gene’s eye view on the one hand, and more organism-centred evolutionary models on the other. (shrink)

First the ‘Weismann barrier’ and later on Francis Crick’s ‘central dogma’ of molecular biology nourished the gene-centric paradigm of life, i.e., the conception of the gene/genome as a ‘central source’ from which hereditary specificity unidirectionally flows or radiates into cellular biochemistry and development. Today, due to advances in molecular genetics and epigenetics, such as the discovery of complex post-genomic and epigenetic processes in which genes are causally integrated, many theorists argue that a gene-centric conception of the organism has become problematic. (...) Here, we first explore the causal implications of the following two central dogma-related issues: (1) widespread reverse transcription—arguing for an extension from ‘DNA-genome’ to RNA-encompassing ‘NA-genome’ and, thus, from traditional DNA-centrism to a broader ‘NA-centrism’; and (2) the absence of a mechanism of reverse translation—arguing for the ‘structural primacy’ of NA-sequence over protein in cellular biochemistry. Secondly, we explore whether this latter conclusion can be extended to a ‘functional primacy’ of NA-sequence over protein in cellular biochemistry, which would imply a limited kind of ‘gene/NA-centrism’ confined to the subcellular level of NA/protein-based biochemistry. Finally, we explore the conditions—and their (non)fulfilment—for a more generalised form of gene-centrism extendable to higher levels of biological organisation. We conclude that the higher we go in the biological hierarchy, the more dubious gene-centric claims become. (shrink)

Philosophy in the City (or PinC, as it came to be known) is an outreach programme led by student volunteers from the University of Sheffield's Department of Philosophy. It aims to bring philosophy out of the university and into the wider urban community, stimulating young and older minds through events and activities organised with local partners, including schools, charities, and a homeless shelter. Since its inception in 2006, the project has seen hundreds of student volunteers from the university engage in (...) philosophical conversations with thousands of local residents from a wide variety of backgrounds. Sixteen years on, what can we learn from the achievements and shortfalls of this initiative? The present paper is not a systematic review of the project’s history, but a retrospective dialogue between the two authors who both participated in its foundation and its early development: Alexis Artaud de la Ferrière was the project’s first President and Joshua Forstenzer its third. In the course of this dialogue, they revisit the initial motivations and ambitions undergirding the project, discuss the obstacles faced throughout their respective tenures of leadership, and analyse the evolving mission of the project against the backdrop of historic changes in English higher education which occurred during this period. Si l’ouvrage de Bergson souffre indéniablement de maladresses et de contre-sens, parfois partagés par les physiciens de son époque, il n’en demeure pas moins notable que les tentatives contemporaines de construction d’une théorie quantique de la gravité sont traversées par d’inédits questionnements sur la nature du temps et résonnent tout particulièrement avec certaines intuitions bergsoniennes.
